Government Agencies and Administrative Rules Bills
This update looks at government bills related to government agencies and administrative rules. There were too many government bills to cover in one update. Today will cover 11 government bills, on Wednesday the 6th we will cover 15 bills, and on Monday the 11th we will cover the remaining 13 government bills.
AB180 was signed into law by the governor as 2025 Wisconsin Act 116. As part of the nationwide effort to encourage healthy choices, Foodshare benefits in Wisconsin, which are funded by the taxpayer, will no longer be able to be used to buy junk food. We aren’t saying less affluent people can’t treat themselves to cookies or cake now and again like everyone else. But the taxpayer will no longer be buying those for them. In addition, this bill provides state support to the counties who administer the Foodshare program as there were administrative costs shifted by the Feds and the state had to make up that difference.
SB267 was signed into law by the governor as 2025 Wisconsin Act 224. This law requires a court, if the court declares a rule invalid, to award the party asserting the invalidity of the rule reasonable attorney fees and costs. Sadly, the governor vetoed this bill. Apparently, he doesn’t feel the government should have to pay people when the government breaks the law.
AB565Â modifies requirements for a business to be considered as a qualified new business venture for the purpose of receiving investment. The changes include: This bill removes the 51 percent in-state employment requirement;Â defines a business as out of state if the headquarters is outside of Wisconsin;Â and raises that threshold to $20,000,000 for taxable years.

SB289Â changes requirements related to proposed administrative rules that will pass costs to businesses, local governments, and individuals. It would require a full consideration of both costs and savings created by a new administrative rule. Again, this was vetoed by the governor, who must not want the people to see the full economic impact of rules his bureaucrats impose on the people.
AB955Â specifies that no agency may implement an administrative rule interpreting the provisions of any statute enforced or administered by the agency without explicit and specific statutory authority.
AB995Â changes the default effective date for a permanent administrative rule to be the first day of the seventh month after publication. The bill also extends the initial effective period of an emergency rule from 150 to 180 days. The governor vetoed this bill.
AB793 creates an Office of Internal Audit attached to the Department of Employee Trust Funds. The governor vetoed this bill.
AB1027Â requires DHS to share certain information regarding FoodShare benefits with the federal Food and Nutrition Service (FNS). Unfortunately, the governor vetoed this bill.
AB870Â modifies the Wisconsin income tax code to conform to the federal Internal Revenue Code.
AB662Â prohibits state agencies from contracting with businesses that have a certain relationship with a foreign adversary. I was disappointed that the governor vetoed this bill that aims to protect Wisconsin from potential dangers.
